3. Services of the App

The app offers in particular the following functions:

  • Provision of information about animals, enclosures, facilities, and other zoo offers
  • Display of map content within the zoo grounds
  • Location-based display of own position, provided the corresponding device permission has been granted
  • Calculation of routes within the zoo grounds
  • Selection of certain routing preferences, in particular wheelchair-accessible paths

There is no entitlement to a specific availability, completeness, or constant currency of the app.

4. Free Use

The use of the app is free of charge.

No separate contract for paid digital services is concluded. Any connection costs of your mobile or internet provider are to be borne by you.

5. Availability and Technical Restrictions

The publishers and operators strive for the most trouble-free provision of the app possible. However, availability at all times, uninterrupted, or error-free operation cannot be guaranteed.

The use of individual functions may be restricted in particular by:

  • missing or unstable internet connection
  • technical faults of the end device, operating system, or app store services
  • maintenance work
  • temporary server failures
  • inaccurate location determination by the end device

The app may be further developed, changed, restricted, or temporarily discontinued at any time, provided there is a factual reason for this.

6. Map, Routing and Location Functions

The map and routing functions serve exclusively for orientation within the zoo grounds.

The paths, routes, and notices displayed in the app do not constitute binding safety, rescue, or hazard notices. The signage on site, barriers, instructions from staff, and the actual conditions on the ground always remain authoritative.

The use of the location function requires that you allow the app access to the location of your end device. Without this permission, location-based functions may be restricted or unusable.

7. Wheelchair-Accessible Paths

To the extent that the app enables the selection of wheelchair-accessible paths, this is a supporting technical function based on the path information available in the app.

No guarantee is given that a suggested path is in fact completely barrier-free, safe, or usable without restriction at all times in individual cases. The actual conditions on site remain authoritative.

8. Content of the App

9. Map Data and OpenStreetMap (Offline Maps)

The map data is provided as offline maps with the app or via updates to the map data and is stored locally on the device. No connection to external map servers is required to display the map; in this regard, no usage data is transmitted to OpenStreetMap or its contributors when using the map.

OpenStreetMap data is subject to the Open Database License (ODbL); map representations derived from it may additionally be subject to license conditions for the map graphics.

11. Download via App Stores; Relationship with Apple and Google

The app is made available for download via the Apple App Store (Apple) and the Google Play Store (Google). In the app stores, Technische Hochschule Wildau acts as developer and provider of the app.

For the download, installation, and updating of the app via an app store, the terms of use and contractual conditions of the respective store operator additionally apply. These conditions are concluded between you and the respective store operator; we are not involved.

Apple and Google are neither providers nor co-responsible parties for the content or operation of the app. They solely provide the distribution platform.

Claims in connection with the app are directed exclusively against us as the provider, not against Apple or Google. Any statutory warranty rights against the store operator remain unaffected.

To use an app store, you regularly need a user account with the respective store operator. For this account and the associated data processing, only the respective store operator is responsible.

The app does not offer in-app purchases or paid functions.

12. Permitted Use

The app may only be used within the scope of the intended purposes.

In particular, the following is prohibited:

  • abusive or technically damaging use of the app
  • attempting to circumvent security mechanisms
  • automated reading of the app outside the intended interfaces
  • use of the app in a way that impairs or endangers technical operation

13. Rights to the App and Content

14. Liability

The City of Eberswalde and Technische Hochschule Wildau are liable for damages under the statutory provisions only:

  • in cases of intent or gross negligence
  • in cases of culpable injury to life, body, or health
  • in cases of mandatory statutory liability

In the case of slightly negligent breach of essential obligations, liability is limited to the typically foreseeable damage. Liability for lost profits, indirect damages, or consequential damages is otherwise excluded, to the extent legally permissible.

3. Technical Operation of the App

The app is provided technically via systems and servers deployed by the joint controllers. This includes in particular the hosting of the app infrastructure, the provision of content, technical operation, and the routing function within the app.

Technical operation takes place entirely on systems operated by Technische Hochschule Wildau. No external processors are involved. Should technical service providers be added in future, this will only be done on the basis of a data processing agreement pursuant to Art. 28 GDPR.

4. Provision of the App and Server Log Files

When using the app, content such as animal information, images, map material, and technical updates are retrieved from the servers used for the app. For technical reasons, certain personal data is processed in this context.

Data processed:

  • IP address
  • Date and time of access
  • Requested content
  • Technical access and connection information, to the extent necessary for the provision of the app

Processing takes place exclusively to provide the requested content, to ensure the technical functionality and stability of the app, for IT security, and for error analysis and troubleshooting.

Storage duration: The log data generated in this context is stored in server log files and automatically deleted after 14 days. No further personal data is stored permanently on the server side.

11. Data Subject Rights

Unless special provisions conflict, the following data subject rights are granted to the data subject, which (except for point 11.5) should appropriately be asserted with the entity named under point 1, or if that is not known, with the entity named under point 2.

11.1 Access, Rectification, Erasure, Restriction

Each data subject has:

  • the right to request the controller to erase the relevant personal data pursuant to Art. 17 GDPR; and
  • under the conditions of Art. 18 GDPR, the right to demand restriction of data processing.

11.2 Right to Object

The data subject may object to the processing of their personal data for the performance of tasks pursuant to Art. 6 para. 1 letter e GDPR on grounds relating to their particular situation, unless the controller can demonstrate compelling legitimate grounds for further processing.

11.3 Data Portability

Where processing is carried out by automated means on the basis of the data subject's consent, they have the right to request the provision of their data in a structured, commonly used, and machine-readable format.

11.4 Right of Withdrawal

Where the processing of personal data is based on the consent of the data subject, they have the right to withdraw it at any time with effect for the future. The data subject is informed with the consent about the right of withdrawal and the manner in which it can be exercised.

11.5 Right to Lodge a Complaint
